The US Supreme Court has ordered the government to facilitate the return of Salvadoran man Kilmar Abrego Garcia, who was wrongly deported to El Salvador as part of President Donald Trump’s crackdown on undocumented migrants. Garcia, who is married to a US citizen and had protected legal status, was deported due to an administrative error and is not a member of the MS-13 gang as claimed by the government. The court’s decision has been hailed by Garcia’s lawyer as a victory for the rule of law.
Following the lower court’s order to return Garcia to the US, the Supreme Court granted an emergency stay, putting the order on hold but clarifying that the remainder of the District Court’s order remained in effect. The government argued it no longer had jurisdiction over Garcia once he was in El Salvador and called the lower court’s orders unprecedented and indefensible. The White House’s deal with Salvadoran President Nayib Bukele to house alleged gang members in a high-security jail was also mentioned.
Human Rights Watch has called for transparency regarding the treatment of those moved to CECOT prison and denounces the cruelty of the deportations by the US and El Salvador governments.
