International Court Dismisses UAE’s Role in Sudan Genocide Case

The Hague – In a pivotal ruling on Monday, the International Court of Justice (ICJ) rejected a case brought by Sudan against the United Arab Emirates (UAE) that accused the Gulf state of complicity in genocide during the ongoing Sudanese civil conflict. Citing a lack of jurisdiction, the court, by a vote of 14-2, denied Sudan’s request for provisional emergency measures against the UAE and officially removed the case from consideration, supported by a narrow 9-7 majority.

Both nations are signatories to the 1948 Genocide Convention; however, the UAE excluded itself from a crucial clause allowing legal disputes to be taken to the ICJ when it ratified the treaty in 2005. Sudan’s allegations center around claims that the UAE has been arming and financing the Rapid Support Forces (RSF), paramilitary factions accused of committing atrocities against the Masalit ethnic group in Darfur.

The Emirati government promptly dismissed Sudan’s claims, asserting that the evidence presented was neither credible nor substantiated. "Today’s decision represents a rejection of the Sudanese Armed Forces’ attempts to misuse the Court for propaganda," stated Reem Ketait, an Emirati foreign ministry official.

While the ICJ refrained from deciding on the merits of Sudan’s allegations, it expressed concern over the humanitarian crisis unfolding in the country, which has seen widespread death, famine, and the displacement of nearly 13 million people since the conflict reignited in April 2023. The RSF, emerging from past militia groups, has reportedly committed ethnic cleansing, while the Sudanese military is alleged to have targeted civilians using chemical weapons.

As hostilities escalate, the situation remains dire, drawing in various regional actors, including the UAE, which has been linked to covert operations supporting the RSF.
