When Can Convicted Murderers Be Considered Rehabilitated?


Erik and Lyle Menendez are facing a crucial moment in their decades-long imprisonment for the 1989 shotgun murders of their parents. After over three months of delays, they are scheduled for a hearing regarding a prosecutor’s recommendation to reduce their life sentences to 50 years to life, which would make them eligible for immediate parole if approved by Judge Michael Jesic.

The Menendez brothers, now 54 and 57, have spent over 30 years in prison, and their case has sparked intense debate about rehabilitation in the criminal justice system. Former Los Angeles County District Attorney George Gascón, who recommended the resentencing, pointed to the brothers’ positive prison behavior, including college courses and community projects. Gascón argued that state law mandates consideration of age at the time of the crime, as both brothers were under 26 when the murders occurred.

However, Gascón was voted out of office, and his successor, Nathan Hochman, has expressed skepticism about the brothers’ claims of rehabilitation. Hochman argues that the brothers have not taken full responsibility for their crimes, citing a list of alleged lies they have told regarding the events of the murders. In their trials, the brothers claimed self-defense, a claim unsupported by evidence, which led to their convictions in 1996.

As the hearings approach, a comprehensive risk assessment indicated that the brothers pose a “moderate” risk of violence upon release, adding complexity to the proceedings. Despite these challenges, their attorney, Mark Geragos, maintains that the prosecution’s arguments do not undermine the brothers’ efforts at rehabilitation. Should the court deny resentencing, the brothers have options for clemency and further legal challenges.
