Supreme Court Upholds DC’s Ban on Large Capacity Magazines


The Supreme Court recently upheld a longstanding gun restriction in Washington, D.C. that bans magazines capable of holding more than 10 rounds of ammunition, avoiding new challenges to gun rights. This decision came shortly after rejecting a similar case in Rhode Island and confirming Maryland’s ban on assault-style weapons, including the AR-15 rifle. Despite having a conservative 6-3 majority that typically favors gun rights, the Court has resisted taking further actions that might expand gun rights post its significant 2022 ruling, which affirmed that the Second Amendment allows the right to bear arms beyond one’s home.

The recent challenge involved four gun owners who argued that the magazine restriction violated their rights following the 2022 decision. However, both a federal judge and the U.S. Court of Appeals for the District of Columbia Circuit upheld the law. The appeals court, in a 2-1 decision, noted that while large-capacity magazines qualify as arms under the Second Amendment, they can be regulated due to their perceived danger.

D.C. has long been central in legal battles surrounding gun regulations, notably highlighted by the landmark 2008 ruling establishing an individual right to bear arms for self-defense within the home. Meanwhile, the Supreme Court also declined to take on a significant election case concerning mail-in ballots in Pennsylvania, leaving in place a lower court ruling that allows voters with defective mail-in ballots to submit an in-person ballot. This decision had been contested by the Republican National Committee, with the Democratic National Committee supporting the Pennsylvania ruling.
