Emails Reveal ICE Denied Mahmoud Khalil’s Request for Closer Detention to His Newborn Son

Pro-Palestinian activist Mahmoud Khalil, who has been detained by Immigration and Customs Enforcement (ICE) for nearly three months, recently had a request to transfer closer to his family denied. Held in a Louisiana facility since March, Khalil’s legal team sought to move him to a detention center in New Jersey to be nearer to his wife, Dr. Noor Abdalla, and their newborn son, born in April. ICE’s policy mandates that detained parents with custody of minor children should be held close to them, yet the New Orleans ICE Field Office rejected Khalil’s request, claiming he did not meet their criteria for transfer without providing an explanation.

Nora Ahmed, legal director of the ACLU of Louisiana and part of Khalil’s legal representation, condemned the decision as “cruel,” stating it undermines families in contravention of ICE’s own regulations. The directive, which was put in place in 2022, aims to facilitate regular contact between detained parents and their children. Khalil’s lawyers emphasized that there is no justification for his detention far from his family, especially given the proximity of detention centers to their location in New York City.

Khalil, a permanent U.S. resident and graduate student at Columbia University, became a notable activist during pro-Palestinian protests. He was arrested in March under serious accusations without being charged with any crime. Despite previous requests, including one to attend the birth of his son, ICE has consistently denied his requests. Khalil experienced the birth of his son only through a phone call while detained, marking a painful separation. His meeting with his son occurred just before an immigration hearing last month.
